Demand / Recovery Provisions under Model GST Law ‘a’ Draconian Law?
Section 51 of Model GST Law pertains to "determination of the tax not paid, short paid or erroneously refunded. This is parallel to section 11A of the present Central Excise Act, 1944, where under the demand of duty short paid, not paid or erroneously refunded is raised and a process of adjudication gets initiated. The first step is the issuance of show cause notice, quantifying the amount of duty proposed to be demanded.

Frequently Asked Questions (FAQs) on GST
GST is a single tax on the supply of goods and services, right from the manufacturer to the consumer. Credits of input taxes paid at each stage will be available in the subsequent stage of value addition, which makes GST essentially a tax only on value addition at each stage. The final consumer will thus bear only the GST charged by the last dealer in the supply chain, with set-off benefits at all the previous stages.

Model GST Law : Key Provisions You Must Know

GST is the most revolutionary reform in Indirect Taxation.  GST aims to solve large number of disputes in respect of multiple tax levy. Ministry of Finance has released new Model GST Law with large number of important inclusions.

The proposed Model GST law has been widely worded and includes multiple mechanisms like input tax credit, valuation on transaction basis, time of supply, point of tax, refund provisions, penalty provisions and transitional provisions. We have summarised the key provisions in tabular form.
